DENPASAR – Giacomo Bellatin Indiveri (39), a foreigner from Peru was sentenced to rehabilitation for 8 months because he was stated as a user of 24 cannabis seeds weighing 0.46 grams.
The trial chaired by Judge Estard Oktavi at the Denpasar District Court on Monday (12/08/2019) agreed with the prosecutor that the Peruvian businessman violated Article 127 Paragraph 1 letter a of Law Number 35 Year 2009 concerning narcotics.
“The defendant’s misuse of narcotics, class I in the form of 24 cannabis seeds weighing 0.46 grams”, the judge said. The conviction was lighter 10 months from the demands of prosecutor Paul Agung who was represented by Dipa Umbara in a previous trial demanding that the defendant be sentenced to 18 months in prison.
Hearing the judge’s decision, the defendant who was accompanied by his lawyer Baginda Sibarani said he accepted. Whereas the prosecutor expressed his thoughts. The arrest of the defendant was carried out on 13 August 2019 at the Ngurah Rai International Arrival Terminal in Bali because it was suspected that the suitcase he was carrying had suspicious objects during an X-ray examination.
Because they were suspicious, Ngurah Rai Bali Customs officers then took the defendant and his goods to the examination room. When the briefcase was opened the officers found 8 packages containing cannabis seeds totaling 24 seeds.
When interrogated, the defendant confessed to buying the prohibited item while on vacation at the Red Line, Amsterdam, the Netherlands, which was deliberately brought to Bali for his own use.
